Registration in the Partner Program
To use our services, it is necessary to register by creating a user account. An account will be issued after providing the necessary information and verifying it in accordance with applicable legislative requirements. These requirements include compliance checks with anti-money laundering and counter-terrorism rules, as well as, in the case of companies, verification of your business details. All provided information must be truthful, accurate, and complete. If we find that the information is false, inaccurate, or incomplete, we have the right to deny you access to the website or resources, as well as terminate or suspend your account. An individual may have only one account (except for legal entities). It is prohibited to use services on behalf of other individuals. You cannot sell, transfer, share, or provide your account or access data to anyone else. You are responsible for the security and control of your username, password, authentication code, or other data necessary to access the services. Providing false or fraudulent information is prohibited, including the use of a non-personal phone number. It is also prohibited to create fake account information, falsify the country of origin, or provide fake identification documents. Violation of these rules may result in the termination or suspension of your account. You have the right to delete your account and cease using the services at any time. You are responsible for all obligations incurred prior to termination. By registering and using our services, you confirm that you comply with applicable laws and regulations governing the activities in the field of financial services, cryptocurrency operations, or similar areas in your jurisdiction.
Parties
The terms "client" and "you" refer to the subscriber of the platform services, as defined in the Application, whether it is an individual, legal entity, or another organization. You may use the platform services only if you accept these Terms of Service and have the necessary authority and legal basis to enter into a contract with us. Any individual who subscribes to the platform services or uses them on behalf of a company or another organization represents and warrants that they have the appropriate authority and intention to bind that company or organization to these Terms of Service.
Termination
This Agreement shall enter into force from the date we approve your application to participate in the Partner Program and shall remain in force until terminated as specified in this document. After the closure of your account, we retain your personal information in the database for a period of one year. Financial information related to our collaboration, such as commissions and other payments, is stored for approximately 5 years in accordance with our legal obligations. We guarantee the secure storage of information until the end of the retention period, after which it will be deleted.
Confidentiality
By accepting this Agreement, the parties agree that all information, including the terms and circumstances of this Agreement, financial and business information, pricing and sales information, as well as customer and supplier lists, related to us or our affiliates and provided by them or on their behalf, shall be considered trade secrets. The parties also acknowledge their responsibility for any breaches of the Agreement. This category also includes any attempts to use a similar selection of sponsors and products using the same rotation system as (company name). Please note that this information should be used exclusively within the scope of your participation in the Partner Program, except in cases where such information is publicly available or accessible to the public from other sources other than yourself.
Payouts
In accordance with the terms of this Agreement, we will pay the Partner a Commission for each Conversion. The size of the Commission will be determined based on tracked Conversions, reports, statistics, rates, payments, and other campaign-related data, according to our Tracking System. The Partner agrees that data obtained from the Tracking System takes precedence over other measurement methods. The Partner undertakes to provide us with all necessary information, including details for Commission payment. An automatically generated invoice will be issued on behalf of the Partner for all Commissions payable under this Agreement. Payment based on this invoice is made within 30 days after the end of the period, unless otherwise agreed by the parties. If the Partner disagrees with the size of the Commission stated in the invoice or the campaign data defined in the Tracking System, the Partner must submit any claims or disputes in writing within 24 hours of the invoice issuance. If no claims or disputes are submitted during this time, it is considered that the Partner agrees with the size of the Commission stated in the invoice, and all settlements are deemed final. Interest does not accrue on the commissions we are obligated to pay to the Partner. As the Partner acts as an independent contractor, they are solely responsible for payment of all fees and/or taxes based on the income received under this Agreement. If the Partner's account remains inactive for a period of six months and the Partner does not request payment of their commissions during this period, all commissions may be deemed invalid and deducted from the balance, and the account may be deactivated.
Terminations
This Agreement becomes effective upon approval of your application to participate in the Partner Program and remains in effect until terminated in accordance with the terms outlined here:
- You have the option to terminate your participation in the Partner Program at any time by removing all links from your Media and deleting all copies of the links.
- We have the right to terminate your participation in one or more offers presented by WhiteLead or in this Agreement at any time and for any reason we deem necessary, with or without prior notice, by closing the links or sending you a written notification.
- We may close your account if you have not used it for 2 or more months.
Upon termination of your participation in one or more offers presented by WhiteLead or in this Agreement for any reason, you are required to immediately cease using and remove all links and intellectual property of Detailed Graphics kft, and cease to act as a CPA (Cost Per Action) affiliate of the WhiteLead network for one or more offers. All rights to legitimate payments, claims, and any provisions that are intended to survive in accordance with their terms shall be preserved upon any termination. However, if we terminate this Agreement due to your violation of its provisions, threats of violation, or if we believe that you intend to violate this Agreement, you will not be paid any commissions, even if they were due at the time of termination.
Fraud
The use of any means, individuals, devices, mechanisms, or agreements for the purpose of committing fraud, violating the law, interfering with the activities of other partners, or distorting data regarding link clicks, commission generation, or unauthorized access to the affiliate program is prohibited. These actions include, but are not limited to, the use of tracking software, automated tools to increase the number of link clicks or fill in required information, information-stealing programs, as well as methods such as "cookie stuffing" and other forms of fraud or deception. The company strictly prohibits your use or the use by third parties directly or indirectly associated with you of any proxies/VPNs or inappropriate tools and methods, and reserves the right to immediately withhold payment for all leads generated through proxies/VPNs or other prohibited tools and methods. WhiteLead independently makes all decisions regarding fraudulent activity. The partner must not add leads or clicks based on false premises or obtain leads or clicks by generating fraudulent traffic. The company may refuse to pay for leads obtained through proxy servers/VPNs and other inappropriate tools and methods detected by WhiteLead's internal fraud protection system. Any attempt or occurrence of fraud is grounds for immediate termination of your account and withholding of any unpaid amounts in your favor.
